The Whangamata Marina

As many will have heard, the Minister of Conservation, Chris Carter, has decided to veto the new marina at Whangamata despite it being okayed by the Environment Court after a 11 year resource consent process. For some unknown reason, he is allowed this right as part of the Resource Management Act.

Nick Smith says that National proposed an amendment bill back in early 1999 to repeal that (and other sections as well) but it was dropped by Labour after they got into power.

Those proposing the marina are planning to apply for a judicial review of Carter's decision, but I'm afraid I don't see how they can get it overturned. The Act says that the Minister must make a decision based on the recommendation from the Environment Court and he must give reasons for his decision. Chris Carter has done that.

While I disagree with his decision, I doubt that there are any grounds for judicial review.
