The Smoking Law

Russell Crowe's smoking on stage incident at SkyCity has raised some questions about the anti-smoking law that was passed sometime ago. It made smoking indoors in public places illegal, including bars, RSA clubs, etc. But the legal obligation was on the venue, not the individual smoking - i.e. if you smoked in one of those places you were not breaking the law. It was the venue who was at fault.

This was pointed out at the time, but ignored by those pushing for the law change.

I opposed the law at the time, as I didn't think that the government should be enforcing anti-smoking rules in private venues - particularly with places like RSAs, or bars like the Cigar Bar. If bar owners were opposed to smoking, they could simply ban smoking in their establishment. If the patrons were opposed, they could only go to bars that banned smoking.

But even if you claim that the law itself is a good idea, it seems wrong to remove all personal responsibility and only punish the venue - surely the individual should be punished as well.
