Labour's pledge cards and the police non-prosecution

TVNZ reported last night that the Police had sufficient evidence to prosecute Heather Simpson over Labour's pledge card fraud during last year's election, yet decided not to prosecute because the law was unclear. Fruthermore, they never asked Crown Law for any legal advice on the law.

The Chief Electoral Officer was quite surprised by this. The Electoral Office thought it was clearly illegal, sought Crown Law advice, which confirmed it was illegal, and handed it off to police. The police decided to ignore it.

Murray McCully has all the details in his latest newsletter, and points out that the 2005 election select committee review will be interesting when the Chief Electoral Officer makes his appearence.
