Liberterians sue Labour

The leader of the Liberterians party is suing the Labour party over their spending of taxpayers money on the pledge cards during the last election. Specifically they are claiming that the money was allocating by an appropriation bill for the explicit purpose of supporting Labour MPs in Parliament (not for re-electing them). The claim is that the Constitution Act and Public Finance Act make it illegal for public money to be spent except by an act of Parliament (hence the annual appropriation bills).winXP manager serial

They are only seeking a declaration that the money was spent illegally and costs. I am not a lawyer, so I am not very sure what will happen with this, my guess is that the Labour party's lawyers (or Crown lawyers if they manage to get the taxpayer to pay for it) will argue the following:winXP manager serial

The appropriation bill provides the money to Parliamentary services to assist parties in Parliament. The rules for how this money is spent is governed by the Office of the Clerk, and the rules are confusing and need to be reviewed. This is already being done so there is no need for the Court to be involved. Heck, they may even claim Parliamentary Privilege about how that money is spent.winXP manager serial

I think that it does raise important issues and should go to trial, but that is very unlikely.winXP manager serial
